These Terms of Service ("Terms") govern your access to and use of the Gregator website, products, and services (collectively, the "Service"), operated by Gregator ("we", "us", or "our"). By creating an account or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service you represent that you meet this requirement and have the authority to enter into these Terms.

2. Your account

You are responsible for safeguarding access to your account and for any activity that occurs under it. You must provide accurate information and keep your email address up to date. Notify us at [email protected] if you suspect unauthorized use of your account.

3. Acceptable use

You agree not to use the Service to:

• Break any law or infringe another person's rights.
• Generate or distribute content that is illegal, defamatory, harassing, hateful, or sexually exploitative.
• Attempt to breach security, disrupt the Service, reverse-engineer it, or circumvent rate limits.
• Scrape, crawl, or bulk-extract data from the Service.
• Resell, sublicense, or provide the Service as a white-label offering without written permission.

We may suspend or terminate accounts that violate these rules.

4. Content and ownership

Your content. You retain ownership of the topics, prompts, and notes you create. You grant us a worldwide, non-exclusive license to host, process, and display your content solely to operate and improve the Service.

Generated content. Courses, chapters, and chat responses are generated by AI models based on public sources. You are free to use the generated content for personal and internal business purposes. You are responsible for verifying its accuracy before relying on it for any decision.

Our content. The Service — including its code, design, branding, and documentation — is owned by Gregator and protected by copyright, trademark, and other laws. These Terms do not transfer any of those rights to you.

5. Plans and payment

We offer free and paid plans. Paid plans are billed in advance on a recurring basis (monthly or annually). Prices, features, and limits are described on the pricing page and may change; we'll give you advance notice before a price increase takes effect on your account.

You can cancel at any time. Cancellation takes effect at the end of the current billing period and does not entitle you to a pro-rata refund, except where required by law.

6. Third-party services

The Service integrates with third-party AI and search providers. Your use of those integrations is also subject to their respective terms. We are not responsible for third-party service outages, content, or policies.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the AI-generated content will be accurate, complete, or suitable for any specific use.

8. Limitation of liability

To the maximum extent permitted by law, Gregator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim (or €100 if you have not paid us anything).

9. Indemnification

You agree to defend and indemnify Gregator against claims, liabilities, damages, and expenses arising out of your use of the Service, your content, or your breach of these Terms.

10. Termination

You can delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we're required to by law. Upon termination, your license to use the Service ends; provisions that by their nature should survive termination will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll notify you by email or in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Poland, without regard to its conflict-of-law principles. Any disputes will be resolved in the competent courts of Warsaw, Poland, unless otherwise required by applicable consumer protection law.
